5. Automated decision-making
Traqeer uses automated systems, including artificial intelligence models, to find and classify search results and to decide which content is proposed for a claim. Those systems do not make decisions with legal effects on you: the Customer and the Traqeer team can review and correct any result, and claims are submitted under the Customer’s authorization. Traqeer does not build profiles for other purposes.
6. Who we share data with
- Platforms. Each removal request includes the data the Platform needs to process it: the name of the Customer or of the Creator, the reference to the protected content, the address of the claimed content, the accuracy statement and a means of contact. Some Platforms forward those details to the party responsible for the claimed content or publish them in transparency databases.
- Providers that process data on Traqeer’s behalf and only under its instructions: hosting of the application, of the databases and of the storage of documents, screenshots and evidence (Railway); email delivery (SendGrid); payment processing (Stripe); automation and artificial intelligence services that receive the registered names and aliases to search for and classify results; providers of access to search engine and platform results, which receive the search queries; product and website analytics (PostHog and Google Analytics); campaign measurement (Meta), which receives the hashed email address and name when the account is created and when a payment is made; internal operations and support tools (Slack); and WhatsApp when the Customer chooses that channel to talk to Traqeer. The current list of providers may be requested at info@traqeer.com.
- Authorities, administrative or judicial, when required by law.
- Agencies. When an Agency registers a Creator, the Agency sees that Creator’s data and actions in its account.
Traqeer does not sell personal data or share it for advertising purposes.
7. International transfers
Media Defender LLC is based in the United States and processes data there; its providers process data in the United States or in other countries outside the European Economic Area. For persons residing in the European Economic Area, Traqeer applies the safeguards provided for in Articles 44 to 49 of the GDPR: Standard Contractual Clauses approved by the European Commission with its providers, the EU-U.S. Data Privacy Framework where the provider is certified, or equivalent safeguards. You may request a copy of the applicable safeguards at info@traqeer.com.
8. How long we keep data
| Data | Period |
|---|---|
| Account and Customer data | While the account is active and up to five years after the last action, to handle possible claims |
| Identity documents, proof of ownership and signed statements | While the account is active and up to five years after the last claim in which they were used, unless you request their deletion earlier and there is no obligation to retain them |
| Evidence and records of the claims submitted | Five years from the last action, to evidence the requests and to defend against claims |
| Screenshots verifying the status of links | Thirty days |
| Records of report and notice deliveries | Up to one hundred and eighty days |
| Records of support sessions on your account | One year |
| Backups | Up to ninety days from each backup |
| Payment data and invoices | Kept by Stripe for the periods required by applicable tax and accounting rules |
| Analytics and measurement data | The periods configured in each tool; you may object at any time |
| Contact inquiries | One year from the last communication |
When each period expires, the data is deleted or anonymized. If you request the closure of your account, Traqeer cancels the subscription, closes the account and deletes the data that does not have to be retained for the reasons above; the subscription record is kept as a billing record.
9. Your rights
You may exercise your rights of access, rectification, erasure, objection, restriction of processing and portability, and withdraw your consent, by writing to info@traqeer.com with the subject line “Data protection” and attaching a document evidencing your identity. Traqeer replies within one month, extendable in complex cases.
If an Agency registered your data as a Creator, you may exercise your rights before the Agency or before Traqeer; Traqeer will forward the request to the Agency where appropriate.
If you reside in the United States, the privacy laws of your state may grant you rights of access, correction, deletion and portability, and the right not to have your data sold or shared for targeted advertising. Traqeer does not sell personal data or share it for those purposes. You may exercise those rights through the same email address, and Traqeer will not treat you differently for exercising them.
If you consider that the processing does not comply with the law, you may lodge a complaint with the data protection authority of your country of residence.
10. Security
Traqeer applies technical and organizational measures proportionate to the risk: encryption of data in transit and at rest, access restricted to authorized personnel, access logging, backups and internal confidentiality procedures. Identity documents are stored with restricted access and are used only for the actions that require them.
11. Minors
The Service is intended for persons aged 18 or over. Traqeer does not create accounts for minors or knowingly process their data. If you become aware that a minor has provided data, write to info@traqeer.com so that it can be deleted.
12. Cookies and analytics
traqeer.com uses technical cookies necessary for it to work and, only with your consent, analytics cookies that help understand how the site is used. You may accept, reject or change your decision at any time from the “Analytics preferences” button.
The application uses the storage necessary to maintain your session and preferences and, in addition, product analytics (PostHog and Google Analytics) that records how its screens are used in order to detect errors and improve the Service, on the basis of Traqeer’s legitimate interest. That data is associated with the account, is not used for advertising purposes and is not disclosed to third parties other than the providers listed in Section 6. The application also sends Meta, with the email address and name hashed, the account creation and payment events, to measure Traqeer’s campaigns. You may object to these processing activities by writing to info@traqeer.com.
13. Data provided by Agencies
When an Agency registers data of its Creators, the Agency is responsible for having a legal basis to do so and for informing the Creators. Traqeer processes that data as a processor on the Agency’s behalf, under the conditions of Section 16 of the Terms and Conditions of Service.
14. Changes to this policy
Each version of this policy bears a number and an effective date. Relevant changes are communicated to Customers by email and in the application before they take effect. Previous versions are kept and may be requested.
